 De Sá Moreira Clinic presents an integrated offer, developing its activity through the provision of dental medicine and dentistry services.

ASM CLÍNICA MEDICINA DENTÁRIA LDA (hereinafter referred to as the “Entity”, “De Sá Moreira Clinic”, “we”, “us”) legal entity number 515 733 326, headquartered at Rua António Martins Soares Leite 50, 4520-150 Santa Maria da Feira, Aveiro, with operating license nº 19431/2020 is responsible for the website www.desamoreiraclinic.pt.

When accessing the company’s website, you agree with the use that De Sá Moreira Clinic may make of the personal information that you submit or that is collected within the scope and terms of this privacy policy. By providing any personal information to the website www.desamoreiraclinic.pt, you unequivocally understand and accept the collection and processing of this personal information as well as its possible transfer to other partners, in accordance with the provisions set out in this privacy policy and with the regulations in effect. We collect only the information strictly necessary to process your order. In each situation, it is informed whether or not the requested data is required to be collected.

Accessing our website and providing your personal data implies knowledge and acceptance of this Privacy Policy.

3. Who is responsible for the Data

De Sá Moreira Clinic is responsible for processing the personal data it collects through the website www.desamoreiraclinic.pt within the scope of the activities and services developed by its clinic, as well as for the data collected at events, conferences or street actions with a view to disseminating and promotion of services and products, with your prior consent.

4. How we collect your data

In this Privacy Policy, the term “Personal Data” means the set of information that relates to you and that allows us to identify you, directly or indirectly. Your personal data will be collected and processed by De Sá Moreira Clinic in the following situations:

If you contact us directly, namely:
through our website – by completing the form to schedule appointments at the clinic and/or if you have other questions by sending us a contact request; or even when applying for a job;
when you contact us by phone;
when you contact us via one of our external customer support emails;
when you go to our clinic and show interest in our services by leaving us your contact details;
when you contact us through social networks to schedule an appointment or respond to one of our campaigns carried out through social networks;
If you participate in one of our events or direct marketing campaigns, such as street campaigns or oral awareness actions;
When you go to our clinic for a consultation or another service we provide;
We also collect the data necessary to consider you for a job when you apply with us, including academic and professional qualifications, work experience, contact details and references.
If your data is sent to us by our partners or third parties, to the extent that the requirements in this regard set out in data protection legislation have been met.

5. Data that may be collected

Personal information may be requested, including but not limited to:

Contact details: Name, address, telephone number and email address;
Data Personal Characteristics: Gender, age, date of birth;
Health data and Consultation: Health history of diseases and allergies, as well as oral health data; Information regarding your use of the services we make available to you at our clinic, including but not limited to the type of treatment, substances and materials used, and specific laboratory work;
Transaction and interaction data: such as the taxpayer number, your requests for information and suggestions, as well as any participation in market research.
Other personal data: Information that has been provided to us about your birthday, photo, education, household / family situation;
Interests: Information that you have provided on topics of interest to you, for example type of treatment / Medical Areas, participation in hobbies, promotions and events or other personal preferences;
Website usage data: Information about how you use the website and whether you have opened or forwarded messages from us, including data collected through cookies or other tracking technologies.

You may also choose to voluntarily disclose other information while using the Website or when you send us an email, which we do not request. In such cases, you will be solely responsible for such information.

6. For What Purposes We Use Your Data

All the information we collect is recorded, used and protected in accordance with current national and community legislation on data protection and with this privacy policy.

Your data will be processed in accordance with at least one legal basis under the General Data Protection Regulation (GDPR) and for the following purposes:

Provision of a Service and Assistance to the Customer (Art. 6º(1) al. b), c) and f) of the RGPD)

De Sá Moreira Clinic uses your personal data to issue invoices for the services provided, manage your consultations (scheduled consultation confirmation), define your Treatment Plan, respond to requests for information and doubts (which has not been possible reply immediately)
as well as occasionally for inquiries about the quality of the service provided (according to our legitimate interests in order to identify how we can improve the service we provide to you).

It also uses your data to ensure the success of all proposed treatments, since it is necessary to be aware of information regarding health in order to guarantee the well-being of the patient (Allergies/diabetes/pregnancy, etc.)

De Sá Moreira Clinic also processes your data within the scope of this purpose, to optimize your experience with our customer support service, for example to correctly identify you whenever you contact us.

Communications with the holder (Art. 6 (1) item a), b) and f) of the RGPD)

We use your personal information to communicate with you in relation to the different De Sá Moreira Clinic Services requested by you, through different channels (for example, by telephone, SMS, email, chat)

Promotional communications, information and campaigns based on your consent, carried out by email, telephone or SMS about our services and conditions made available ((Art. 6º (1) al. a) of the RGPD))

If you have given us your consent for the further use of your data, these may be used in accordance with the scope described in the respective personal data collection declaration. This is the case, for example, of consent for promotional purposes (offers and promotion of products and services).

You may withdraw your consent at any time, with effect for the future. For this purpose, see section ‘8. Holder’s Rights’.

Compliance with legal obligations to which De Sá Moreira Clinic is subject (Art. 6 (1) al. c) and f) of the RGPD)

De Sá Moreira Clinic will also process personal data if it has a legal obligation to do so. This may be the case, for example, with issuing invoices. De Sá Moreira Clinic is subject to a multitude of legal obligations. We may process your personal data as necessary to fulfill these obligations, as well as transmit them to the authorities upon notification.

7. Minors’ Privacy

De Sá Moreira Clinic is committed to protecting the privacy of children and young people and only collects personal data from holders under the age of 18 with written authorization from their parental guardian.

Parents/guardians and guardians of minors under the age of 13 are encouraged to regularly supervise their children’s e-mail use and other internet activities.

8. Holder’s Rights

In accordance with GDPR regulation (EU) 2016/679, you may request, at any time, access to personal data concerning you, as well as its rectification, deletion or limitation of its treatment, the portability of your data, or oppose its processing – once the legally established conditions have been verified.

As the data subject, you also have the right to withdraw your consent at any time. The withdrawal of consent does not compromise the lawfulness of the treatment carried out based on the previously given consent.

At De Sá Moreira Clinic, a request to exercise a right as a data subject will only be accepted if made in writing, to comply with a legal obligation on the part of De Sá Moreira Clinic. For this purpose, one of the means made available and contained in this Privacy Policy must be used. De Sá Moreira Clinic’s response to requests received will also be made in writing or by electronic means such as email, within 30 days, as required in article 12 of GDPR (EU) 2016/679. The holder’s identity can be verified, so if not enough data is sent to identify the holder, additional data may be requested.

In general, requests to forget verbal data are not considered valid. For any requests made via the website, De Sá Moreira Clinic’s response will always be via email or mail and not via web channels.

10. Data Sharing

Data transfer outside the European Union

The personal data collected and used by De Sá Moreira Clinic are not made available to third parties established outside the European Union. If, in the future, this transfer takes place, De Sá Moreira Clinic undertakes to ensure that the transfer complies with the applicable legal provisions, namely regarding the determination of the suitability of such country with regard to data protection and the requirements applicable to such transfers.

De Sá Moreira Clinic may communicate your personal data to/when:

Subcontracted entities for the purposes described in this Privacy Policy, under the terms of the contracts entered into with them, including but not limited to authorized financial intermediaries, in the case of opting for a financing agreement; with our authorized partners, in the case of need for construction or maintenance of dental prostheses with our authorized partners, in the case of orthodontic appliances; with entities that provide services in the field of health insurance, in the case of using health insurance.
Such data communications are necessary or appropriate under the applicable law, are carried out within the scope of compliance with a legal obligation/judicial order, a decision by the National Data Protection Commission or another competent supervisory authority, or to respond to requests public or governmental authorities;
11. Personal Data Retention Period

According to Art 5º (1) al. e) of the RGPD, your personal data will be kept for the period of time necessary for the purposes for which they were collected or for the period of time legally required by other legislation in force in the Portuguese State to which De Sá Moreira Clinic has to respond.

12. How do we keep your personal data safe

We use a variety of security measures, including encryption and authentication tools, to help protect and maintain the security, integrity and availability of your personal data.

Although the transmission of data via the internet or website cannot guarantee complete security against intrusions, we and our service providers have made the best efforts to implement and maintain physical, electronic and procedural security measures aimed at protecting your personal data in compliance with applicable data protection requirements. Among others, we implemented the following:
